1. General Provisions
These General Terms and Conditions (hereinafter "Terms") govern all transactions between Garage Marseille (hereinafter "the Seller") and its customers (hereinafter "the Customer").
Effective date: January 28, 2024
By purchasing our products or services, the Customer acknowledges having read and accepted these Terms without reservation. These Terms prevail over any other document.
2. Vehicle Sales Conditions
2.1 New Vehicles:
• Delivery subject to manufacturer availability
• Prices include standard equipment as per manufacturer specifications
• Optional extras invoiced separately
• VAT included at current rate (20%)
• Registration fees and first-year insurance not included
2.2 Used Vehicles:
• Minimum 12-month warranty or 20,000 km
• Vehicle condition as described in the technical sheet
• Full service history provided when available
• Pre-delivery inspection and preparation included
• Roadworthiness certificate provided
2.3 Test Drives: Available by appointment, subject to availability and presentation of valid driver's license and insurance.

4. Pricing and Payment
4.1 Prices: All prices are in Euros (€) and include VAT. Prices are subject to change without notice until order confirmation.
4.2 Payment Methods Accepted:
- Bank transfer
- Credit/debit cards (Visa, Mastercard, American Express)
- Cheque (with valid ID)
- Cash (up to €1,000)
- Financing through approved partners
4.3 Payment Schedule:
New Vehicles:
• 10% deposit upon reservation
• 40% upon order confirmation
• 50% upon delivery
Used Vehicles:
• Full payment before or upon delivery
5. Delivery and Transfer of Ownership
5.1 Delivery Terms: Delivery takes place at our premises (139 Rue Ferrari, 13005 Marseille) unless otherwise agreed.

5.3 Transfer of Ownership: Ownership transfers upon full payment. Registration remains the Customer's responsibility.
6. Warranty and After-Sales Service
6.1 New Vehicles:
• Manufacturer's warranty (typically 3 years/100,000 km)
• Roadside assistance included
• First service included within 6 months/15,000 km
6.2 Used Vehicles:
• 12-month warranty on engine and transmission
• 6-month warranty on electrical components
• 3-month warranty on accessories
• Warranty excludes wear and tear items
6.3 Warranty Claims: Must be made in writing within 7 days of discovering the defect. Vehicle must be presented for inspection.
7. Right of Withdrawal
7.1 Distance Sales: For online purchases, the Customer has 14 days from receipt to exercise the right of withdrawal.
7.2 Exceptions: The right of withdrawal does not apply to:
- Vehicles purchased at our physical premises
- Custom-ordered vehicles
- Vehicles registered in the Customer's name
- Service and repair contracts
7.3 Return Conditions: Vehicle must be returned in original condition with less than 500 km and no damage.
8. Service and Repair Terms
8.1 Estimates: Free estimates provided upon vehicle inspection. Estimates valid for 30 days.
8.2 Authorization: Written authorization required before commencing repairs exceeding €150.
8.3 Parts:
Original Parts: Recommended for optimal performance and warranty
Quality Equivalent Parts: Available as cost-effective alternatives
Customer-Supplied Parts: Not recommended, warranty void on fitted parts
8.4 Completion Time: Estimated completion time provided but not guaranteed due to parts availability and complexity.

10. Limitation of Liability
10.1 General: Garage Marseille's liability is limited to the contract price, except in cases of gross negligence or willful misconduct.
10.2 Indirect Damages: We are not liable for indirect damages including loss of profits, use, or data.
10.3 Force Majeure: Neither party is liable for delays or failures due to circumstances beyond reasonable control.
10.4 Customer Property: We are not liable for personal items left in vehicles during service.
11. Website Usage Terms
11.1 Access: Access to our website is free of charge. The Customer is responsible for connection costs.
11.2 Intellectual Property: All website content is protected by intellectual property laws. Reproduction prohibited without authorization.
11.3 Content Accuracy: While we strive for accuracy, we cannot guarantee all information is current or complete.
11.4 Links: We are not responsible for third-party websites linked from our site.
12. Complaints and Dispute Resolution
12.1 Complaint Procedure:
- Written complaint to customer service
- Response within 10 business days
- If unresolved, mediation proposal
- Legal action as last resort
12.2 Mediation: In case of dispute, the Customer may contact the Médiateur des Garagistes (Mediator for Garages):

13. Applicable Law and Jurisdiction
13.1 Governing Law: These Terms are governed by French law.
13.2 Jurisdiction: Any dispute shall be submitted to the competent courts of Marseille, France.
13.3 Language: These Terms are drafted in English. In case of discrepancy with a French version, the French version prevails.
14. Modifications and Validity
14.1 Modifications: Garage Marseille reserves the right to modify these Terms at any time. Current version available on our website.
14.2 Severability: If any provision is invalid or unenforceable, remaining provisions remain valid.
14.3 Entire Agreement: These Terms constitute the entire agreement between parties.
